"" The world of compliance has undergone extraordinary transformations in the past few years. From predictable, technical, and largely invisible to outsiders, the world of compliance has become unpredictable, politicized, and highly strategic. One of the most challenging aspects of the new world of regulation, once national in nature, has to do with the globalization of norms, and specifically American norms, as evidenced by the crackdown of American regulators on foreign financial institutions. Extraterritoriality, international diffusion, and changes in international law and jurisprudence have taken center stage. The talk will focus on the internationalization of regulation of money laundering and terrorist financing, sanction enforcement, anti-corruption, and new regulatory and judicial practices, ranging from settlements based on a plea-bargaining logic (deferred prosecution agreements and non prosecution agreements) to the encouragement and protection of whistleblowers.
